My daugther was recently divorced & my ex son in law has made an agreement with her that because he has a lot
of debt , he will not be able pay any maintenance for his child or herself. I heard that he has intention of making quarbani
& when i spoke to him about this, he said i should mind my own business, I would like clarity on this as i believe that
quarbani is not wajib on one who has debt & it would be better for him to pay his debt & also in this case at least
contribute to the well being of his child.

My wife and I decided on marriage day that we will have 2 kids inshallah. Now Alhamdulillah we have a 3 year daughter and my wife is expecting. We want to maintain the decision of having only 2 kids, it is haraam to do so if we have mutually agreed upon it?

I would like to know what options are available to me , I have been talking to a girl but now realised it is wrong , I am not yet able to support a wife myself , I am still studying . But I want to get married to this girl, So how long is it permissible to be engaged/proposed? Is it ok to be married but your wife not live with you as yet until the time is right just so that the relationship can be halaal?
    Please advise, Jazakallah

  • Ismdalal

    Assalam W W Mufti Saheb,

I hope that you are in the best of health with the grace and mercy of almighty allah.

My friend was married for 12 years. Last year around March, his wife separated from him with no valid islamic reason. Her husband really tried to convince her to come back but all in vain. Some months later, her reltives came to my friend and told him that they wanted to collect all her clothing as well as all things she had brought from her mothers place. He gave them the keys and went for work. When he came back, he saw that they took all the movable items: all kitcehn itms like plates, sppons etc, blankets, bed sheets, pillow cases. In short all items that were bought in 12 years of marriage. They are claiming that all the itms are for her becuase it was bought with the money he gave for house expenses and after all expenses she used to buy the items mentioned. Just after taking everything, she asked for a divorce immediately. They have now divorced.

My question Mufti Saheb is that is his ex wife entitled to those items that she took?

My second question is if one gives his wife money for house expenses and from that money, she buys items for the house like kitchenware, beddings etc, who is the owner of those things according to the shariah?

    Jazakallah

    • Reem

Dear Ismdalal, i think the wife has nothing if she ask for divorce from her side justifying to the Islamic law she doesn’t have any clear reason for the divorce. However, if she had a clear reason for asking the divorce, she has the right to  ask for the money and the expenses
just related to her dowry, the money her husband wrote to her as one condition  of ending the marriage

Due to the nature of how these cell phone programs are sold, some phone models allow me to charge for it and some do not allow me to charge for my program because of legal and infrastructure issues regarding payments. The question that came in my mind is whether it is permissible in islam to sell the same program (on different phone models) for different prices? (so one phone model has the program for free and the same program you have to pay on another phone model)

A muslim lady has tatoos on her body.  What is the punishment thereof and what will her position be regarding ghusal. Can she be present when ghusal is given to another muslimah and can she be present in the same room where the murhoom muslimah is.  Please be so kind to inform regarding this lady.  She does not stop piercing her body and having her body tatoo’d.  She is three children two of who are baligh already.

    Honourable Mufti Saab
I am a young married man who has recently bought a home which has been financed through the bank. I am also trying to make changes in my life for the better and have been listening to lectures about usury and interest dealings. What advice can mufti saab provide me with.  After seeking advice from many people there were 2 common opinions.
•The first opinion being you are not eating the interest and in the current day and age one will not be able to buy a home with cash. You have no option but to purchase through the bank.
•The second opinion being it is totally forbidden so rent
I am sure that there are many young married couples who are facing the same dilemma. Please assist in making the correct decision. Shukrun

    Assalamu alaikum warahmatullah wa barakath
    Honourable Mufti Saab
What is Mufti Saab’s opinion on the European Nasheed artist like Maher Zain, Irfan Makki and all other artists using musical instruments? I saw an interview whereby the same question was posed to the artists in which they replied that there is a difference in opinion amongst scholars regarding musical instruments. They say some Ulema condone this because the music they produce has only had positive effects amongst the ummah. It is directed to get the youth gripped into hearing songs of the prophet (SAW), Allah’s (SWT) and other issues like parents, etc. instead of listening to rave or love songs from the west.
    What musical instruments are permissible?

    As salaam u alikum
Is there a ruling regarding married children living with there parents?
I have a son that is married, and has two children living with me, apparently to foster mutha at. This is not achieving the results, I sense that he has taken responsibility for his family, and works on occasion. Goes out in Jamaat, however lives of the parents, and has made no effort in the home or with his family. Enmity is growing and he has made no effort to find a place to stay, in order for him to take care of his family and feel the pains of responsibility. While at home the parents take care of all his needs, and he has not saved on dime, instead lives lavish with him money, saves little to none.
Is there a ruling on living with ones parents.

Second question, his wife is in nikaab, and the home has Bligh boys, brother to my son. Should she wear nikaab in front of her brother in laws, as I feel this once again has been selective. My son reprimands her for leaving the house without nikaab, however not in front of his brothers.

Mufti-A close family member of mine has gotten a 2nd wife. He spends
the entire week with wife #2 in one town and visits wife #1 and his
children, who live in another town, every ALTERNATE weekend, but he takes wife #2
with him as she has family in that town, but then doesn’t devote his entire
weekend to wife #1 and his children,he also spends time with wife #2. Wife #1
is now suffering medically and emotionally. Besides that, his children are also
suffering, they always had their fathers attention and love and now they’re not
getting any at all that they actually sit up till late at night looking out the
window waiting for him. Wife #1 is also a family member and is getting no
support from the husbands immediate family (her inlaws), they have basically
written her off after just meeting wife #2 twice. Wife #1 is a very quiet and
soft natured person whereas wife #2 is loud and pushes her way. What is your
    opinion on this situation?

    Salaams =)

This weekend is the Top Gear Festival and a lot of muslims are jumping to go when we know that its big night tomrw night and Ramadhaan is coming closer..
I  noticed this hype on facebook..and i updated this status….
“Everyones running to go Top Gear Festival..who’s running to Allah?? The days are numbered for Ramadhaan and tomrws big night, we should be in our houses..at the masjid, spiritually preparing =)..and fyi, before anyone has anything to say, i was offered to go to the Top Gear Festival, but i declined, coz who wants to be there when they’re suppose to be praying =)#disgusted”

the response i got was….i am being judgemental…people can do what they want to with their money etc etc…
i continued to point out that im not being judgemental,im just voicing my opinion..then i got a response of…i upload pictures,i speak to boys and all my faults were brought to the fore.
I then said..i know i sin and i acknowledge it..but because i realised something islamic and it makes sense i am just advising, but because i sin..and im not perfect,im not allowed to have an islamic opinion ?? people were then saying that i mustnt use religion to suit me, but i feel i wasnt, i was just merely stating a fact and i was being brought down by the muslim community for voicing an opinion i thought was okay

what is your say on this matter??

    Asalamualikum mufti saab

I bought samoosa pur from a local muslim butchery on being told by a family member it was made by a muslim aunty, later she had doubts she had heard it was made by a hindu.  I went to ask the uncle if its made by this hindu person & he told me yes.  He said the majority of muslim ladies in my town are using it.
Doesn’t he have a right to tell the muslims where the pur is coming from, then the onus is on the individual whether to buy or not!  All that hard work & effort, i’d be up til 2-3am preparing, not to mention the expense!  Mufti saab i felt it my duty to make other family members aware whose pur  it was.  Can we consume the samoosas now?  Ramadaan is such a mth of blessing, will it nullify the fasts.  They do poojas, they put money for their idols, they could be using the same money to increase their business by buying t flour to make t pur.  If we can’t use it in Ramadaan can we use it after Ramadaan or is it a definite NO, please can you reply to this urgently as i need to let others know, sukhran

I have recently met a boy, who was interested in me, i resorted to reading Istikhara before anything happens, as he wanted to get married, during the time that i read Istikhara which was a period of 7 days, things changed drastically, he told his parents and also arranged to come see me after eid. i had left for an overseas holiday and on return he he decided that he has a change of heart.
Again i made istikhara twice, but i could not remember my dream both times, aswell as the first time. i would like to know what is the reason for this, and aslo please enilighten on istikhara? i was previously told that it does not have to be a dream in particular, but aslo the happenings around me.

  • bilkish shaik

    Assallamualaikum Mufti Saab.

my name is Bilkish Shaik. i am 21years old. i have a question about sunni and tabliq people. which one is “good” an which is “bad”. my mother is sunni and my dad is tabliq. my parents are now divorced like 13 years now. and my dad has since remarried and i have no contact with him. my brother and i were brought up sunni. my mum believes that one of the contributing factors of her failed marriage is that my dad wasnt sunni. she has forbibben me from marring someone who is tabliq o for me to speak to a tabliq moulana and see excatly where the difference lies. my view is that we are all muslim. and we all believe in what is fard, sunnah, wajib, nafil, makrooh, halaal and haraam. i am very confused as to which side to take. my mum isnt very keen on me being friends with o speaking to tabliq people o even making dua for them. she said she heard once in a lecture by an aalim that it is wrong and all tabliq people do is “window dressing”. many analogies were used to describe them and what they do. my mum has called a suuni moulana to speak with me as she feels im highly misguided and sitting on the fence. we have not seen eye to eye wen its come to this topic and as a result we fight.

please help me. i dont want to hurt my mother and i also dont want to believe o follow something which is wrong. i also cant accept something i dont understand. please shed lots of light on this as soon as possible.
